END USER LICENSE AGREEMENT

Dial is licensed to You (End-User) by MacroMatic LLC, located at 2n 6th Pl, Brooklyn, New York, United States ("Licensor"), for use only under the terms of this License Agreement.

By downloading the Dial application ("Licensed Application") from the designated application store, You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement.

1. THE APPLICATION

Dial is a macro tracking app designed to help users track their macros, create foods, discover new foods, and scan barcodes to log in their daily diet. It is intended for individuals aiming to make progress towards their fitness goals through tracking their food intake, including athletes and individuals seeking to improve their body composition.

2. SCOPE OF LICENSE

2.1 You may not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Licensed Application, or any part thereof, except with prior written consent from Dial.

2.2 You may not copy or alter the Licensed Application or portions thereof, except as expressly authorized by this license and the Usage Rules. You may create and store copies only on devices that You own or control for backup purposes under the terms of this license.

2.3 Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.

2.4 Licensor reserves the right to modify the terms and conditions of licensing.

2.5 Nothing in this license should be interpreted to restrict third-party terms. When using the Licensed Application, You must ensure that You comply with applicable third-party terms and conditions.

3. MAINTENANCE AND SUPPORT

3.1 Dial is solely responsible for providing any maintenance and support services for the Licensed Application. For inquiries or support, please contact sam@macromatic.space

3.2 Dial and the End-User acknowledge that the designated application store and its subsidiaries have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. USE OF DATA

You acknowledge that Dial may access data necessary for the operation of the app, such as macro tracking and barcode scanning. This data is used to provide personalized features and improve the user experience. Dial will not sell or share your personal information with third parties without your explicit consent.

5. USER-GENERATED CONTRIBUTIONS

The application may ask if you would like to create foods or recipes. When you create or make available any Contributions, you represent and warrant that your Contributions comply with applicable laws and are not false, misleading, harmful, or unlawful. Contributions should not include unauthorized advertising or violate the privacy of others.

1. Your Contributions are not false, inaccurate, or misleading.
2. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
3. Your Contributions are not obscene, lewd, lascivious, violent, harassing, or otherwise objectionable (as determined by us).
4. Your Contributions do not violate any applicable law, regulation, or rule.
5. Your Contributions do not violate the privacy or publicity rights of any third party.

6. CONTRIBUTION LICENSE

Contributions to the app, such as progress photos, food creations, or recipes, will never be shared without explicit permission from you, the user.

7. LIABILITY

7.1 Licensor's responsibility for damages is limited to cases of intent or gross negligence, except in cases where essential contractual duties (cardinal obligations) are breached. In cases of slight negligence, liability is limited to foreseeable, typical damages.

7.2 Licensor is not liable for content posted by users. You are responsible for ensuring that your contributions comply with applicable laws. Normal contributions, such as recipe suggestions, will not subject you to liability unless they explicitly violate the law.

8. WARRANTY

8.1 Dial warrants that the Licensed Application is free of viruses or malware at the time of download. It warrants that the application functions as described.

8.2 If Dial confirms the application is defective, the issue will be remedied by providing a replacement or a solution to the defect.

9. PRODUCT CLAIMS

Dial is responsible for addressing claims related to the Licensed Application. The designated app store is not responsible for handling any product claims.

10. MISCELLANEOUS

If any provision of this agreement is deemed invalid, the remaining provisions shall remain in full force and effect. This agreement may only be waived or amended in writing.
